GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Purpose

These General Terms and Conditions of Sale (GTC) define the rights and obligations between:

  • The online store (hereinafter "the Seller"),
  • and any natural or legal person placing an order (hereinafter "the Customer"),

in the context of the online sale of construction materials, tools, and related products.


2. Products

The store sells:

  • construction materials (cement, plaster, sand, bricks, wood, etc.)
  • plumbing, electricity, hardware, household goods, paint
  • power and hand tools
  • accessories and consumables

Each product includes:

  • a description
  • an indicative photo
  • a price including VAT
  • its weight / technical specifications

The Seller makes every effort to ensure the accuracy of the information.
Photos may have minor variations.


3. Prices

The displayed prices:

  • are expressed in Moroccan Dirhams (MAD)
  • include Moroccan VAT
  • do not include delivery fees

The Seller reserves the right to modify its prices at any time.
The applicable price is that displayed at the time of the order.


4. Order

The Customer validates their order after:

  1. product selection
  2. cart confirmation
  3. entering delivery information
  4. payment validation

This validation constitutes an unreserved acceptance of these GTC.

The Seller reserves the right to cancel any order:

  • in case of suspected fraud
  • in case of obvious error in price or product
  • if the product is unavailable

In this case, the Customer will be fully reimbursed.


5. Payment

Accepted payment methods are:

  • Secure online payment (Moroccan bank cards)
  • Cash on delivery (if available)
  • Bank transfer (optional)

Online payment is secured via our certified partners.
The Seller never has access to the Customer's banking data.


6. Delivery

6.1 Served Areas

The Seller delivers in:

  • Greater Casablanca for heavy products exceeding 45 kg
  • All of the Kingdom of Morocco for light products, therefore under 45 kg

6.2 Delivery Times

  • Light products: 24 to 48 working hours
  • Heavy products / materials: 24 hours to 5 days

6.3 Conditions for Heavy Materials

For products such as cement, sand, mortar, plaster, bricks, tiles, wood:

  • delivery to the truckside only
  • no delivery to upper floors or inside the construction site
  • the Customer must ensure:
    safe truck access
    handling for unloading
    presence on site for verification and signing of the delivery note

6.4 Verification upon Delivery

The Customer must:

  • check the package condition
  • report any damage on the delivery driver's slip
  • refuse the goods if necessary

No claim will be accepted after 24 hours without proof.


7. Returns and Right of Withdrawal

7.1 Affected Products

In accordance with Law 31-08, the Customer has:

  • 7 days to return an UNOPENED and UNUSED product.

7.2 Non-Returnable Products

The following products are EXCLUDED from the right of withdrawal:

materials whose packaging has been opened
opened bags of cement, plaster, or mortar
used or installed items
cut, weighed, or custom-prepared materials
Sand, gravel, bricks, wood
any heavy product damaged after customer unloading

7.3 Procedure

The Customer must contact:

Returns are accepted only after written validation by the Seller.
Return shipping costs are at the Customer's expense, except in case of proven defect.


8. Defective Products

If a product is delivered:

  • broken,
  • defective,
  • or incorrect,

the Seller will offer, depending on the case:
replacement
credit
refund

Proof (photos/videos) is required within 24 hours of delivery.


9. Personal Data

Collected data is used for:

  • order management
  • delivery
  • billing
  • customer relations

No data is transferred outside of Morocco.
The Customer may request:

  • access
  • modification
  • deletion

10. Responsibilities

The Seller is not responsible for:

  • incorrect use of products
  • risks associated with handling by the Customer
  • delays caused by the carrier
  • refusal of delivery if truck access is impossible

The Customer is responsible for:

  • providing an accurate address
  • being present at the time of delivery
  • arranging for unloading of heavy materials

11. Invoicing

An invoice is issued after payment and sent by email.


12. Force Majeure

Neither party is responsible in case of an unforeseeable event impacting the execution of the contract:

  • natural disasters
  • strikes
  • logistical breakdowns
  • closed roads
  • exceptional shortages

13. Applicable Law – Jurisdiction

These GTC are governed by Moroccan law.
In case of dispute, the Moroccan courts of the Seller's registered office have jurisdiction.
